Appeal Filed to Reinstate Lawsuit Over Oklahoma Bathroom Law

A federal appeals court is being asked to reinstate a lawsuit challenging an Oklahoma bathroom law that requires public school students to use restrooms based on their biological sex, not their gender identity.

The original lawsuit was dismissed earlier this year by a federal judge, but civil rights groups and families involved in the case have now appealed the ruling.


Appeal Argues Bathroom Law Violates Title IX

Attorneys for the plaintiffs argue the law violates Title IX, the federal statute that prohibits sex-based discrimination in education. They also claim it violates the Equal Protection Clause of the U.S. Constitution by treating transgender students differently from their peers.

Supporters of the appeal say the law singles out a small group of students and could lead to discrimination or unsafe conditions for transgender youth.


Oklahoma Law Remains in Effect During Appeal

The bathroom law remains in effect while the case moves through the appeals process. School districts statewide must continue enforcing restroom use based on sex assigned at birth, as written in the statute.

A decision from the appeals court could determine whether the lawsuit returns to district court or is permanently dismissed.
