A federal appeals court will now decide the future of in-state tuition denied for undocumented Oklahoma college students, after three students filed notice of appeal.

They were forced into higher out-of-state costs after a federal judge removed their access to in-state pricing as they approach graduation at Oklahoma universities.

Attorney General Gentner Drummond says he will oppose the appeal and defend the ruling that removed in-state status. His office argues immigration education policy must remain consistent with current federal requirements and state statute compliance.
