Cherokee Nation Bans Hyperscale Data Centers On Tribal Land
The Cherokee Nation has officially banned hyperscale data center development on tribally owned and trust land, saying the long-term protection of natural resources, water supplies and Cherokee culture outweighs the potential economic benefits of large-scale technology projects.
The decision follows months of research by a tribal task force and comes as Oklahoma continues attracting billions of dollars in artificial intelligence and technology investments. While projects continue to move forward elsewhere across the state, Cherokee Nation Principal Chief Chuck Hoskin Jr. said future developments within the reservation must include meaningful consultation with the tribe before construction begins.
Cherokee Nation Bans Hyperscale Data Centers To Protect Tribal Resources
In a statement published by the Cherokee Nation, Principal Chief Chuck Hoskin Jr. said tribal leaders have a responsibility to protect Cherokee citizens, land and cultural resources from projects that could significantly affect future generations.
"It’s clear that our Cherokee Nation Administration, Council and citizens have serious concerns about the construction of hyperscale data centers on our tribal lands, which affect our resources and cultural lifeways," Hoskin said.
Under the new policy, hyperscale data centers will not be permitted on Cherokee Nation trust land or tribally owned property.
The tribe also announced it will not support similar projects proposed on privately owned land within the Cherokee Reservation unless developers first engage in meaningful consultation with Cherokee leaders and citizens. Those discussions must address issues such as water consumption, electrical demand, environmental impacts and the protection of cultural resources before the tribe will consider supporting a project.
Cherokee Nation Bans Hyperscale Data Centers After Citizen Survey
The policy follows the release of a report prepared by the Principal Chief's Task Force on Data Centers, which was created earlier this year to study both the opportunities and challenges associated with large-scale AI infrastructure.
The task force surveyed nearly 1,600 Cherokee Nation citizens, finding that 64 percent opposed hyperscale data center construction within the reservation, while only 14 percent supported the projects. The remaining respondents said they were undecided.
The report also notes that the Cherokee Nation has full authority over development on tribal trust and tribally owned land but has limited authority over privately owned land within reservation boundaries.
According to the Cherokee Nation Government and Real Estate Services, the tribe oversees approximately 46,000 acres of restricted land, more than 62,000 acres of tribal trust land, and over 5,100 acres of tribal fee land across northeastern Oklahoma. The Cherokee Reservation itself spans roughly 7,000 square miles, making it one of the largest tribal jurisdictions in the United States.
Data Center Debate Continues Across Oklahoma
The Cherokee Nation's decision comes as Oklahoma has become one of the country's fastest-growing destinations for AI data centers, with companies proposing billion-dollar developments that promise new jobs and economic investment while also raising concerns about electricity demand, water usage and environmental impacts.
At least two proposed projects—Project Clydesdale near Owasso and Project Mustang in Claremore—are already planned within the Cherokee Reservation on non-tribal land. While the tribe cannot stop those developments outright, leaders say future projects should involve transparent communication with tribal governments before construction begins.
The Cherokee Nation is not alone in raising concerns. The Seminole Nation of Oklahoma approved a similar ban earlier this year, the Kickapoo Tribe of Oklahoma has publicly opposed data center development on its lands, and the Muscogee Nation is continuing to study the potential impacts of large-scale technology facilities. As demand for artificial intelligence infrastructure continues growing nationwide, the U.S. Department of Energy has identified data centers as one of the fastest-growing sources of electricity demand in the country, making the debate over future development likely to continue across Oklahoma.
