Oklahoma Driver License Data Transfer Lawsuit Filed in State Supreme Court

An Oklahoma driver license data transfer lawsuit has now been filed with the Oklahoma Supreme Court, seeking to block the transfer of driver license information to a nonprofit organization tied to the U.S. Department of Homeland Security.

The lawsuit follows through on a promise made by State Senator Kendal Sacchieri, who says the data transfer could compromise the privacy of Oklahomans who have chosen not to obtain a REAL ID.


Oklahoma driver license data transfer lawsuit gains legislative support

A total of 35 state lawmakers have signed onto the Oklahoma driver license data transfer lawsuit, arguing the transfer would share sensitive information without adequate safeguards.

Lawmakers say their primary concern is protecting data belonging to Oklahomans who opted out of obtaining a REAL ID, which is not required for all residents under federal law.

According to court filings, the data would be transferred to a nonprofit entity associated with federal homeland security operations, raising concerns about transparency and oversight.


REAL ID privacy concerns at center of case

The REAL ID program is administered nationally by the U.S. Department of Homeland Security, but participation remains optional for many purposes. Critics of the data transfer argue that sharing driver license data undermines the choice Oklahomans made when declining a REAL ID.

The Oklahoma Department of Public Safety, which oversees driver licensing, has not publicly commented on the lawsuit’s merits.


Supreme Court review and next steps

The Oklahoma Supreme Court will review the lawsuit to determine whether the data transfer violates state law or constitutional protections. Legal experts note that cases involving data privacy and federal partnerships often raise complex jurisdictional issues.

Sacchieri says the goal of the lawsuit is to pause the transfer until lawmakers can fully evaluate its impact on privacy and data security.
