Lawton councilman rape trial begins in Comanche County
The Lawton councilman rape trial begins today at the Comanche County Courthouse, where former City Councilman Jay Ron Burk faces two felony charges tied to an alleged 2024 incident.
Burk, 59, served on the Lawton City Council for 14 years before the case moved toward trial.
Jury selection is scheduled to begin Wednesday before Comanche County District Judge Jay Walker.
Lawton councilman rape trial centers on October 2024 allegation
The Lawton councilman rape trial stems from an alleged incident on Oct. 14, 2024.
According to court documents and preliminary hearing testimony, prosecutors allege Burk took a man back to his home after a night of drinking.
Burk is accused of sexually assaulting the man while the victim was unconscious on a couch inside the home. The first-degree rape charge involves an allegation that the victim was unconscious, which carries a possible sentence of five years to life in prison without parole if convicted.
Police search tied to alleged explicit photos
The Lawton councilman rape trial also includes a felony charge tied to obscene material.
Investigators allege Burk possessed and shared nude photos of the victim while the victim was passed out.
Lawton police later executed a search warrant at Burk’s home in early 2025 and seized a phone that reportedly contained images connected to the case.
Court records show Burk is charged with preparing, distributing, or exhibiting obscene material.
Defense previously challenged the charges
The Lawton councilman rape trial is moving forward after earlier defense efforts to stop the case.
Burk’s attorneys, Evan Watson and Toni Capra, previously argued that the legal elements of the charges were not met.
However, the judge denied a motion to suspend the charges following testimony during a July 2025 hearing.
Burk has remained out on bond since his arrest.
Trial expected to draw attention in southwest Oklahoma
The Lawton councilman rape trial is expected to be closely watched because of Burk’s former public role and the severity of the allegations.
Proceedings will continue in Comanche County District Court as prosecutors begin presenting evidence.
Updates are expected as testimony continues through the week.
