Former Oklahoma Judge Arrested After Halloween Gunfire

Former Oklahoma Judge Arrested After Allegedly Firing Gun Toward Halloween Trick-or-Treaters
Former Stephens County Judge Jerry Herberger was arrested Halloween night in Duncan, Oklahoma, after allegedly firing a gun toward trick-or-treaters and pointing the weapon at a responding police officer. The 73-year-old former special district judge was taken into custody Saturday, October 31, following reports of gunfire in a residential neighborhood where families were celebrating Halloween.
According to the Duncan Police Department, officers responded to Linwood Lane around 8:02 p.m. after receiving reports that someone had discharged a firearm in the direction of children collecting candy. Herberger was subsequently booked into the Stephens County Jail on complaints including attempted murder, assault and battery with a deadly weapon, and possession of a firearm while intoxicated. Authorities confirmed that no injuries were reported, and the investigation remains ongoing.
Former Oklahoma Judge Accused of Pointing Firearm at Responding Officer
The incident began when Duncan police received a report of gunfire near trick-or-treaters on Halloween night. Officers were dispatched to Linwood Lane, where witnesses directed them toward a residence believed to be connected to the reported shooting.
As officers approached the home, Herberger allegedly pointed a firearm at one of the responding officers. Police have not publicly detailed how many shots were fired during the initial incident or how close the reported gunfire came to the trick-or-treaters.
According to KSWO's November 1 report on the arrest, Herberger eventually complied with police commands and was taken into custody without further incident.
Officers transported him to the Stephens County Jail, where he was booked following the confrontation. No injuries were reported among the children, neighborhood residents or responding officers.
The incident occurred during one of the busiest evenings of the year for residential pedestrian activity, when families and children traditionally travel between homes after dark.
Investigators have not released additional details about what allegedly prompted the gunfire or whether Herberger knew any of the individuals involved.
Jerry Herberger Held on Serious Criminal Complaints in Stephens County
Following his arrest, Herberger was booked on three serious criminal complaints: attempted murder, assault and battery with a deadly weapon, and possession of a firearm while intoxicated.
The allegations involve both the reported gunfire toward trick-or-treaters and the subsequent confrontation with law enforcement. Investigators will need to establish the circumstances surrounding each alleged act as the case moves through the criminal justice system.
At the time of the initial reports, authorities had identified the allegations as booking complaints rather than confirmed formal criminal charges. Herberger was reportedly being held without bail pending further court proceedings.
The distinction is significant because an arrest and jail booking do not establish guilt. Prosecutors must review the investigative findings and determine which charges, if any, will be formally pursued.
Herberger is expected to make an initial court appearance Monday, November 2. Additional information about his custody status, charging decisions and future court dates may become available following that appearance.
Former Stephens County Judge Previously Handled High-Profile Criminal Cases
Herberger's arrest has attracted additional attention because of his previous career in the Stephens County judicial system.
He began serving as a Stephens County special district judge in 2011, following approximately seven years of experience as an assistant district attorney. His legal career included involvement in criminal proceedings that received attention beyond southwest Oklahoma.
Among the most widely recognized cases associated with his judicial service was the prosecution involving the 2013 killing of Australian baseball player Christopher Lane in Duncan. The murder drew international coverage and placed the Stephens County court system under considerable public scrutiny.
Herberger's former position within the local judiciary could raise questions about how the new criminal case will be assigned and prosecuted. However, no official announcement has confirmed that an outside prosecutor will be appointed or that a judge will recuse from the proceedings.
The Oklahoma State Courts Network provides public access to state court docket information, which can be used to follow filings, hearings and other developments as the case progresses.
Meanwhile, Duncan police continue investigating the Halloween incident. Authorities are asking anyone with information to contact the Duncan Police Department at 580-255-2112.
The arrest places a former member of Oklahoma's judiciary at the center of a serious criminal investigation involving alleged gunfire near children and a confrontation with police. No one was injured, and the allegations against Herberger remain unproven as the case moves toward its initial court proceedings.
